Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Whimsical Whim's mobile applications and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We may modify these Terms at any time. Your continued use of the Service after any modification constitutes acceptance of the modified Terms.

Description of Service

Whimsical Whim is a reflection and journaling application that provides season-aware prompts for daily reflection. The Service includes:

  • Daily reflection prompts ("Whims")
  • End-to-end encrypted reflection storage
  • Seasonal calendar and event notifications
  • Optional household sharing features
  • Premium features available through subscription

Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update your account information as needed
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.

Encryption and Data Recovery

IMPORTANT: Your reflection content is encrypted using keys derived from your password. We cannot recover your data if you lose your password.

By using the Service, you acknowledge and accept that:

  • Your encryption key is derived from your password and stored only on your devices
  • If you forget your password and have not set up recovery options, your encrypted data cannot be recovered
  • We cannot decrypt your reflections under any circumstances, including legal requests
  • You are responsible for maintaining access to your encryption credentials

User Content

You retain ownership of all content you create using the Service ("User Content"). By using the Service, you grant us a limited license to store and transmit your encrypted User Content solely for the purpose of providing the Service.

You agree not to create User Content that:

  • Violates any applicable law or regulation
  • Infringes on the rights of others
  • Contains harmful code or malware
  • Attempts to circumvent our security measures

Note: Because your content is encrypted, we cannot monitor it. However, if we become aware of violations through other means, we may terminate your account.

Acceptable Use

When using the Service, you agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated means to access the Service without our permission
  • Share your account credentials with others
  • Create multiple accounts for abusive purposes

Household Sharing

If you use household sharing features, you agree to:

  • Only share with people who have consented to participate
  • Respect the privacy and boundaries of other household members
  • Accept that shared reflections may be visible to all household members
  • Not share the reflections of others outside the household without consent

Subscriptions and Payments

Premium Subscription

Premium features are available through a paid subscription. Subscriptions are billed in advance on a monthly or annual basis.

Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage your subscription through your app store account settings.

Refunds

Refunds are handled according to the policies of the app store (Apple App Store or Google Play Store) where you made your purchase. We do not process refunds directly.

Price Changes

We may change subscription prices with notice. Price changes will not affect your current billing period but will apply to renewals.

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Whimsical Whim and are protected by copyright, trademark, and other intellectual property laws.

"Whimsical Whim," our logo, and related graphics are trademarks of Whimsical Whim. You may not use these marks without our prior written permission.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Whimsical Whim is a reflection tool, not a mental health service. The Service does not provide medical, psychological, or therapeutic advice. If you are experiencing mental health difficulties, please consult a qualified professional.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHIMSICAL WHIM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Whimsical Whim and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the app settings.

Upon termination, your right to use the Service will immediately cease. Your encrypted data will be deleted in accordance with our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of California.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
